What Constitutes Domestic Violence/Simple Assault?
Domestic violence occurs when simple assault is committed against specific people. If you were charged with simple assault or domestic violence, you are likely accused of one of the following:
- You threatened another person, causing them to fear serious bodily injury.
- You negligently caused bodily injury to another person with a deadly weapon.
- You intentionally or recklessly caused bodily injury to another person.
- You physically attempted to injure another person.
Can I Still Face Simple Assault Charges Even if I Didn’t Intend to Inflict Bodily Injury?
Physical injury caused by reckless behavior often occurs in unintentional ways, such as pushing through a crowd of people in a hurry. If your physical acts result in the unintentional injury of another person, you can still face simple assault charges due to reckless behavior. No matter the severity of the charges against you, consulting a trusted defense lawyer is paramount to protecting your rights and reputation.

- Children or spouses who currently live with or formerly lived with the accused.

When Is Domestic Violence/Simple Assault a Felony?
While domestic violence or simple assault is typically a misdemeanor, crimes committed against certain individuals (“special victims”) can lead to felony penalties. These parties include:
