Settlement Reached with Ole Miss in Death of Southaven Football Player

As an experienced wrongful death attorney in Northern Mississippi, it pains me to see youth in our state have their lives cut short. I’m sure you’ve heard of the death of University of Mississippi football player Bennie Abram III during a February 2010 football practice.

Abram grew up in Southaven, Mississippi, where our office is located. His parents, Bennie and Erma Abram, sued Ole Miss in 2011 over the wrongful death of their son.

Recently, a settlement was finally reached, in which the family received $50,000 from Ole Miss and another $275,000 from an NCAA insurance policy, according to an USA Today report. [Read more…]

Fresenius GranuFlo linked to cardiac failure?

You may have heard of some of the Fresenius GranuFlo© cases across the Northern Mississippi and Memphis, Tennessee metro areas. These are class action suits based upon claims made by patients and patients’ families relating to cardiac failure after receiving dialysis at various Fresenius dialysis clinics.

As an experienced medical malpractice attorney in Southaven, Mississippi serving Northern Mississippi and the Memphis metro area, I thought I’d address these claims and help explain what is going on.

To best explain the situation, I’ll use the help of an article from Allnurses.com.

Mississippi DUI Ignition Interlock Law Moves Towards Implementation

A recent report found that more and more ignition interlock devices are being used in Mississippi DUI cases. Given a recent law that was signed into effect by the Governor, the use of the devices is expected to explode in the state.

The law was initially proposed by State Rep. Mark Formby who recently lost his five-year-old niece in a drunk driving accident. In April, Formby pushed for a new law which would mandate the use of ignition interlock devices for those defendants who have had previous DUI convictions.

Formby says that he cannot help but think about how different his family’s life would be had the law been in effect prior to his niece’s death. Formby says in an attempt to spare other families the same pain he endured, he became an avid advocate for the ignition interlock devices which are designed to keep an impaired driving from turning on a car. Deadly Injections Lead To Mississippi Murder Charges

A man in Mississippi has finally received a trial date after being charged following the death of Georgia woman who was given counterfeit cosmetic buttock injections.

The man, Tracey Lynn Garner, will go to trial on June 10 in Hinds County Circuit Court. Garner is one of two people who have been charged in connection with the death of an Atlanta woman, Karima Gordon. The other person who will be charged, Natasha Stewart, was arrested in Memphis back in January. Stewart is an adult entertainer and also goes by the name Pebbelz Da Model. Prosecutors have announced that the two defendants will be tried for depraved-heart murder. [Read more…]

Northern Mississippi Tractor-Trailer Wreck Leaves One Driver Injured

A bad tractor-trailer accident on Highway 78 near Sherman, Mississippi, left one driver in the hospital seeking treatment for serious injuries. The crash involved two semi trucks and happened late one night in early April.

According to Mississippi Highway Patrol officials, the accident happened when David Yell, 34, was heading west on Highway 78 and his Mac tractor-trailer collided with an International semi driven by Cornelius Tolbert. Both drivers were injured in the wreck, but Yell was more seriously wounded.

Police say that when emergency medical responders arrived on the scene of the crash, they transported Yell to the North Mississippi Medical Center in Tupelo, Mississippi, for treatment of his injuries. Thankfully, the damage done to the men was reduced given that both were wearing seatbelts at the time of the accident. [Read more…]

Article Reveals Financial Benefit Of Medical Complications

Though there’s been a lot of talk about the need for hospitals and other medical providers to make serious changes to reduce the instances of patients dying from complications, one thing that has often been left out of the conversation is whether the hospitals might have a disincentive to make such badly needed changes. A recent study that will be published in the Journal of the American Medical Association looked into the issue and came up with some scary conclusions.

The study, done by doctors with Harvard Medical School, found that complications that arise from surgeries and other medical procedures could actually help boost a hospital’s bottom line. [Read more…]

Mississippi Supreme Court Agrees To Hear Case About Criminal Charges For Stillbirths

In an especially tragic case out of Jackson, Mississippi, a woman is appealing her case to the State Supreme Court after being prosecuted for the stillborn death of her child.

The case involves a woman, Nina Buckhalter, who suffered a stillbirth back in 2010. Doctors said that the stillbirth likely occurred because of Buckhalter’s drug use, specifically, because of cocaine. A lower court in Lamar County threw out the charge against Buckhalter, saying there was no evidence that the Mississippi legislature intended to criminalize drug use by pregnant women that might harm their children.

However, prosecutors are arguing that the charge of culpable manslaughter against Buckhalter should be reinstated and that the woman should stand trial. The Supreme Court decided to hear the case and will begin oral arguments later this week. [Read more…]

DeSoto County, Mississippi, Turns Delinquent Criminal Fines Over To Private Collection Agency

If you owe a criminal fine to DeSoto County, you best be on the lookout because a recent move by the local government might result in increased pressure to get their money. The move, made by the DeSoto Board of Supervisors, allowed a private collection agency, Pioneer, to begin the process of collecting money for the county while letting the company keep the delinquency fees for itself.

A recent meeting by the Board of Supervisors ended with a one-year deal that allows Pioneer to track down those people who owe the county money. Pioneer has plenty of experience collecting money, as it is a branch of Sallie Mae, the student loan company, and has also done work collecting for the Department of Education and the IRS. The firm says its recovery rate is about 40 percent, compared to an industry average of only 20 percent. [Read more…]
