Little Boy Dies after Pit bull Attack

A dog attack can happen anywhere, it can be unexpected and potentially deadly.  Small children are especially at risk for life-threatening injuries after being attacked by an animal.

Unfortunately, a five-year-old child in Alabama recently died after injuries given to him by a neighbor’s pet pit bull.  The dog attacked the boy while he was playing in the backyard, according to the news report on the incident.

At the time of the attack, the dog was not on a leash or being restrained by the owner in any way.  Although the dog is only eight months old, he already weighed approximately between 80 and 100 pounds.  [Read more…]

Birth-Related Medical Malpractice

Childbirth is an amazing experience for young mothers. Welcoming a new life into the world, holding your baby for the first time; the enthrallment with your new son or daughter is absolutely incredible.

Unfortunately for many new mothers in Northern Mississippi and Memphis, Tennessee, the experience of childbirth does not always end well. The matter becomes even worse when an injury has occurred due to the negligence or carelessness of the doctor or medical staff in the delivery room.

Birth-related medical malpractice occurs when a doctor, hospital, or other medical fails to use reasonable care. This may lead to injury to the mother or child ruing pregnancy or delivery, wrongful birth, or wrongful pregnancy. [Read more…]

Surgeon’s Hand Dexterity Could Affect Operation Outcome

When you have a condition or injury requiring surgery, fear and nervousness must be quelled by the consideration and promise of your surgeon, showing that you are in good hands.

Unfortunately, not all surgeons are as capable as others. The skill and precision levels of a surgeon often decide the success and recovery time of a surgery.

In a recent New York Times article, many doctors who scrubbed in with two different surgeons noted extreme differences in accidents during the surgery, the elapsed time during the procedure, the amount of infections or complications following surgery, and the recovery time afterwards. [Read more…]

Boxer Dies From Brain Injury

Concussions and brain injuries in sports have taken the legal spotlight in the past few years. Parents and student-athletes, along with coaches, administrators, and politicians, are becoming more aware of the dangers of brain injuries resulting from sports.

As a brain injury attorney serving Northern Mississippi and the Memphis metro area, I too have kept a close eye on any news or studies pertaining to brain injuries in athletics, such as the long-term effects of such injuries and the roles of coaches, trainers, doctors, parents, and the athletes themselves in overall player safety.

A recent article from ESPN caught my attention, highlighting a boxer who died of a brain injury on Oct. 23 after suffering a brutal knockout. [Read more…]

Settlement Reached with Ole Miss in Death of Southaven Football Player

As an experienced wrongful death attorney in Northern Mississippi, it pains me to see youth in our state have their lives cut short. I’m sure you’ve heard of the death of University of Mississippi football player Bennie Abram III during a February 2010 football practice.

Abram grew up in Southaven, Mississippi, where our office is located. His parents, Bennie and Erma Abram, sued Ole Miss in 2011 over the wrongful death of their son.

Recently, a settlement was finally reached, in which the family received $50,000 from Ole Miss and another $275,000 from an NCAA insurance policy, according to a USA Today report. [Read more…]

Mississippi Personal Injury/Wrongful Death Case Dismissed by State Supreme Court

The Mississippi Supreme Court just this month ruled in favor of a group of businesses that were all sued for causing a man’s lung disease and ultimately, his death. The case surrounded Henry Morgan, Sr., as well as 141 other plaintiffs who filed a personal injury lawsuit against 88 separate defendants, claiming injuries related to silicosis. The case dates back as far as September 2002.

The disease is caused by inhalation of crystalline silica dust and is typically seen with inflammation and scarring in the upper lobes of the lungs. Morgan died from the disease while the case was still pending in court and thus did not even live long enough to see its conclusion.

The original case was dismissed in 2006 but a year later Morgan’s son filed a wrongful death claim against 32 defendants, claiming his father’s inhalation of silica had caused his death. [Read more…]

Horn Lake, MS Motorcycle Accident Results in Wrongful Death of Byhalia, MS resident

A 30-year-old Byhalia man was killed in Horn Lake, MS Wednesday night when his motorcycle collided with a car. The Commercial Appeal in Memphis, TN reports that the fatal North Mississippi motorcycle accident occurred at 11:30 p.m. on the corner of Miss. 302 and U.S. 51, in front of the McDonald’s restaurant. Horn Lake Police Department Lt. Scott Evans said the Byhalia motorcyclist, driving a 2001 Suzuki, hit the front of a Ford Mustang that was pulling out of the McDonald’s parking lot. The 18-year-old driver and a 22-year-old passenger in the car both fled the scene after the crash. The driver was found later at his home in Southaven, MS. The passenger was also found near the crash scene, and both were detained and later released pending charges as the Horn Lake Police Department investigates the accident. [Read more…]

Southaven, MS Car Wreck on Interstate 55 Results in Wrongful Death of Child

A tragic car accident on Interstate 55 resulted in the wrongful death of a mid-south child. 8-year-old James Thomas Gray of Southaven was killed when the compact car being driven by one of his relatives was struck from behind by another vehicle. Gray’s 9-year-old sister and the relative who was driving were also injured in the rear-end collision. The driver of the other vehicle was reportedly transported to the hospital for treatment of injuries as well.

It is important to remember that if you have been involved in a crash, or if you have lost a loved one to a crash, you should not speak with the at-fault driver’s insurance carrier until you have consulted an attorney about your rights. Insurance companies, who are looking only at their bottom line, will often attempt to persuade unrepresented parties to settle for less than they may be entitled to. [Read more…]
