If I am stopped while driving in Mississippi and the police officer asks me to do field sobriety tests, do I have to do them?
Any person stopped and being investigated for a DUI does have the right to refuse to do a field sobriety test. You may be arrested if you refuse, but at least at that point if you were going to fail the field sobriety test, you haven’t offered the officer that evidence against you. If you have a physical impairment which prevents you from completing a field sobriety test, it is very important that you inform the officer of that right away so that it can be noted in the officer’s report.
