Can I be arrested for speaking alone?
Speaking alone should not be the basis for an arrest. However, generally speaking, most and a vast majority of speech is protected by the First Amendment. There are several exceptions though to that rule. One of which being yelling fire in a crowded movie theater. That would insight a breech of the peace. Therefore, that would be something that you could be arrested for for speaking alone. If you feel that you have been arrested for speech alone, we always advise our clients to keep your mouth shut if all possible, but wait until after the fact.
