Do I have to give a recorded statement to the insurance company if I was injured in an accident?

We receive this question from clients all the time who are contacted by an insurance company wanting to get a statement from them after an automobile accident. We typically have that statement, if it’s required, done at our office, so that we can participate and make sure that our client’s interests are protected. You do not have an obligation, per se, to provide a recorded statement to another party’s insurance. If your insurance calls and wants a statement about how the accident happened, there is a duty to cooperate which is included in your insurance carrier. We advise all of our clients to cooperate with their own insurance company so that they do not risk losing coverage for the client.
