If I have been in an accident, should I negotiate with the insurance company myself without the help of an attorney?
You’re always free to negotiate with an insurance company without an attorney. We tell our clients all the time that if they wish to negotiate with the insurance company directly, and they would just like a second opinion, we’ll be happy to provide that to them for no charge. However, there are things that the typical layperson does not understand when it comes to negotiation of these types of claims.
Number one, they don’t understand that if they accept money, that they may never come back and make claims in the future for any related injuries. Once you agree to accept the insurance company’s money, that’s it. There’s no more opportunity. Number two, they don’t understand that they’ll be responsible for payment of outstanding bills over and above any settlement amount, including possible claims that would be brought against them by their own health insurance company, known as subrogration claims or liens for treatment.
