Mississippi law requires drivers involved in motor vehicle accidents to stop and remain at the scene of the crash. Mississippi Code Section 63-3-401 (1) states: “The driver of any vehicle involved in an accident resulting in injury to or death of any person shall immediately stop such vehicle at the scene of such accident or as close thereto as possible but shall then forthwith return to and in every event shall remain at the scene of the accident until he has fulfilled the requirements of Section 63-3-405”
The family of a Mississippi motorcycle accident victim may seek compensation for their losses by filing a wrongful death claim against an at-fault or negligent driver. Even if the driver is not found, in some cases compensation may be available through an uninsured motorist claim brought against the deceased’s (or household/family member) own automobile insurance policy.
