A Texas jury recently returned an award in the amount of $497.6 million to five DePuy Pinnacle hip plaintiffs. Approximately $360 million was designated as punitive damages while the remainder of the settlement was for compensatory damages. Prior to this landmark settlement, Johnson & Johnson and its subsidiary, DePuy Orthopaedics, Inc., submitted numerous requests to the Court to divide the trial into two parts in an effort to obtain a ruling on a specific set of legal issues without the Court looking at all aspects of the Plaintiffs’ claims. DePuy also submitted more than ten requests for a mistrial. Bananas Are the Least of Your Concerns When It Comes to Slip and Falls
On Saturday mornings, my family would gather around and watch as Looney Tunes villains targeted our favorite characters with anchors and bombs and laugh as Bugs Bunny and friends would retaliate with none other than…banana peels. Although the banana seems less dangerous than your everyday anchor, the slippery peel would turn the characters upside down and flat on their backs.
This theatrical yet serious act was not invented by the Looney Tunes characters though. Rather, the origin of the dangerous banana began in the early 1900s when the popular fruit peel would be left on the ground to rot and create a slimy, slippery hazard, according to the Myth Busters on Discovery. Little Boy Dies after Pit bull Attack
A dog attack can happen anywhere, it can be unexpected and potentially deadly. Small children are especially at risk for life-threatening injuries after being attacked by an animal.
Unfortunately, a five-year-old child in Alabama recently died after injuries given to him by a neighbor’s pet pit bull. The dog attacked the boy while he was playing in the backyard, according to the news report on the incident.
At the time of the attack, the dog was not on a leash or being restrained by the owner in any way. Although the dog is only eight months old, he already weighed approximately between 80 and 100 pounds. [Read more…]
Fast-Food Employee Denied Health Coverage
Too many employees are denied the coverage they deserve from their employers for injuries received on the job, and employees in the fast-food industry seem to get some of the worst treatment in regards to coverage and compensation.
A Sonic Drive-In worker from Texas had been working for the restaurant for two and a half years when it was one day robbed by two men, according to an article from ABC News. During the robbery, the employee’s leg was broken.
The robber shut the employee’s leg in a door to keep him from making a move to protect a fellow co-worker. The injury happened while he was on the clock. The employee’s broken femur may require surgery. [Read more…]

New Ride-Sharing Companies Raise Dangers
Ride-sharing services are on the rise, but they may not be as safe as they say. After a deadly accident involving a ride-sharing driver in California, questions are being raised about who pays when something goes wrong with this new carpooling technique.
An article from the LA Times discusses how companies such as Uber, Lyft, and Sidecar have previously insisted that the insurance provided to drivers is sufficient to cover accidents, but there is new light shed on the murky legal waters that these taxi-like services operate in.
On New Years Eve, according to the article, an Uber driver hit and killed a 6-year-old child who was crossing the street with her family. It is unclear whether Uber is liable for this fatality.
Uber initially distanced itself from the accident, insisting that the driver was not covered by Uber’s insurance policy at the time of the accident because he was not carrying any passengers. [Read more…]
